Pizza Hut & Jake Palumbo

I'm sitting here, watching "King Of The Hill," and during the break a Pizza Hut commercial comes on, and I swear I've heard the beat during the pitch before. So, I go to the Jake Palumbo Myspace spot, and sure enough, there it is ... on the track "Burt Reynolds." Which now begs the question, where's the beat from, really?

I don't know. I've been meaning to ask him about it, cause I noticed the same thing. Some girl left a comment on his MySpace about suing Domino's.

Jake hit me up with this explanation:

The track uses the same guitar sample that I use in "Burt Reynolds." Simple as that. When I made "Burt Reynolds" I looped the sample as a REX file, dropped it into Reason, and played a new bassline and drums, plus some synth parts for the hook. It's really a minimal arrangement without the vocals and the cutting/scratching. My drum sounds are different than Domino's, but the guitar riff is still the dominant part of the beat.

Now the sample I used is not the rarest of samples...I mean it's not something totally obvious, like looping up "Flashlight" or "Funky Drummer" or "Billie Jean"...but it's one that experienced crate-diggers would probably know. It's from Charles Wright and the Watts 103rd Street Rhythm Band. Their big hit was "Express Yourself", which NWA sampled for their song of the same name.

The Domino's track basically follows the same format...looping the opening riff, plus bassline, plus drums = alot more money from Domino's than I will probably make off of "Burt Reynolds." People have asked me (both joking and serious) am I going to sue Domino's...well, technically Domino's didn't do anything wrong (aside from bite my style). They didn't sample "Burt Reynolds", so I have no ground to say they stole from me.
